Orange/Bouygues merger review jurisdiction depends on timing of deal

05 January 2016 – The potential tie-up of Bouygues Telecom and Orange may be reviewed by either the French competition authority (AdC) or the European Commission (EC) depending on when a deal is signed, according to a spokesperson for Orange.

A deal signed today would likely result in an EC review as Orange’s revenues currently sit just under the EC’s threshold for a member state review.

A deal signed after Orange reports its 2015 annual results on 16 February would likely see the deal reviewed by the AdC, the spokesperson said.
