28 December 2017 – China’s Ministry of Commerce (MOFCOM) is in the process of seeking comments from Chinese third parties regarding the proposed remedies submitted by Bayer [ETR:BAYN] for its acquisition of Monsanto [NYSE:MON], according to two sources familiar with the situation. Third parties are still collecting documents and doing research on whether Bayer’s remedies are sufficient for the Chinese market, the two sources said. It is unclear whether MOFCOM has set a deadline for the third-party feedback regarding remedies, but Monsanto/Bayer is about to enter Phase III of MOFCOM’s current review after a refile in early October. The regulator formally started its review of the case in mid-March 2017.
